When the House Is Caught in the Middle
A divorce is hard enough without a house to sell. If you need to sell your house during a divorce, you’re usually juggling two attorneys, two opinions on what the house is worth, and a mortgage that still comes due every month. One of you may have moved out already. The other may be living with repairs nobody wants to pay for now.
- You both agree the house should go, but not on how
- Listing it the usual way means months of showings, repairs, and decisions you have to make together
- One of you is carrying the mortgage alone until it sells
- You want the house settled so the rest of the divorce can move forward
We can’t make a divorce easy. We can make the house the simplest part of it.
How We Help You Sell a House During a Divorce
We work with both owners, not one side. You each get the same numbers, in writing, so nobody has to wonder what the other person was told. If you’d rather not talk to each other, that’s fine. We can talk with each of you separately, or with your attorneys.
Clear Path House Buyer works with homeowners nationwide. We look at what the house is worth as it sits, what’s owed on it, and what you each need to walk away with. Then you choose: a cash sale, or our Retail Buyer Program, where a licensed local agent lists the house as-is and we coordinate the sale, which can bring more when a cash number won’t cover what you need.
You don’t fix or clean anything, and you don’t have to agree on repairs before selling. You pick the closing date, so it can line up with your divorce timeline, a move-out date, or a court date. You can sign separately with a title company or a mobile notary, and the title company pays out the proceeds the way your agreement or court order says. We don’t take sides on the split.
Divorce situations we work with
- One spouse already moved out, sometimes to another state, and the other is still living in the house
- Behind on the mortgage because one income is now paying for two households
- The house needs work and neither of you wants to pay for repairs before selling
- Divorce not final yet, or already final with an order to sell the house
- A rental or second property that has to be divided too

Selling a House During a Divorce: What to Know
We’re not attorneys, and your attorney should guide the legal side. Here is the general picture so you know what questions to ask.
Every state handles the split differently
Most states divide marital property in a way the court considers fair, which is not always 50/50. A few states, including California, Texas, and Arizona, are community property states. Selling the house turns it into money that can be divided however your agreement or the court decides.
Both owners usually sign
If both names are on the deed, both owners generally sign the purchase agreement and the closing documents. Ask your attorney whether any court order affects when or how you can sell.
The mortgage stays in both names until it’s paid off
A divorce decree doesn’t take a name off the mortgage. If both of you signed the loan, both of you stay responsible for it until the house is sold or refinanced. Selling pays it off at closing.
Waiting periods vary by state
Many states require a waiting period before a divorce can be final. Couples often sell during that time so the house is settled before the judgment.

Sell Your House During a Divorce: FAQs
Can we sell our house before the divorce is final?
Yes, if both owners agree and sign. Many couples sell during the divorce so the house is settled before the final judgment. Check with your attorney whether any court order affects the sale.
Do both spouses have to sign to sell the house?
If both names are on the deed, both owners generally sign the purchase agreement and the closing documents. You can sign separately, at different times and places, with a title company or a mobile notary.
How is the money split when we sell?
The title company pays out the proceeds the way your divorce agreement, court order, or written instructions say. We don’t take sides on the split.
One of us still lives in the house. Can you still help?
Yes. We schedule around whoever is living there and set a closing date that gives them time to move.
What if a cash offer won’t leave us enough?
Our Retail Buyer Program can bring more. A licensed local agent lists the house as-is, and we coordinate the sale. Rachael and Tyler used it when a cash number came in lower than they needed.
Do we have to fix or clean the house first?
No. You sell it as-is. You don’t fix or clean anything.
Can I sell if I’ve already moved out of state?
Yes. Sellers can close remotely or with a mobile notary wherever they live now.
